Perhaps recharge it once more and then try it.How loud are you listening to it? and are you using hte EQ, the backlight settings? VBR huh, judging from your nick, you listen to houe music? As do I and I myself have tons of songs in VBR but this usually isn't the best option and I usually redo them to 192kbps, unless the VBR is higher than I got with 256kbps.
